Acceptance of Terms

By accessing and using the services provided by nextaras S.L. ("nextaras," "we," "us," or "our"), including our fitness centre facilities, personal training services, group classes, nutrition coaching, and website at nextaras.world, you ("user," "member," or "you") agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you and nextaras. If you do not agree to these Terms, you must not use our services or access our facilities.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new Terms.

Company Information

Services Description

nextaras provides fitness and wellness services including but not limited to:

• Access to fitness centre facilities and equipment
• Personal training services with certified trainers
• Group fitness classes and programmes
• Nutrition coaching and dietary guidance
• Fitness assessments and progress monitoring
• Wellness programmes and lifestyle coaching

Service availability may vary and is subject to scheduling, trainer availability, and facility capacity. We reserve the right to modify, suspend, or discontinue any service at our discretion.

Membership and Registration

To use our services, you must:

• Be at least 18 years of age or have parental/guardian consent
• Complete our registration process accurately and truthfully
• Provide valid identification and contact information
• Disclose any medical conditions or physical limitations
• Agree to these Terms and our Privacy Policy

You are responsible for maintaining the accuracy of your account information and notifying us of any changes. You must not share your membership access with others or allow unauthorised use of your account.

User Obligations

As a member or user of nextaras services, you agree to:

Facility Use

• Follow all facility rules and safety guidelines
• Use equipment properly and safely
• Maintain appropriate hygiene and attire
• Respect other members and staff
• Report any equipment malfunctions or safety concerns immediately

Conduct Standards

• Behave respectfully and courteously towards all staff and members
• Not engage in disruptive, inappropriate, or illegal behaviour
• Not use our facilities or services for any unauthorised commercial purposes
• Comply with all applicable laws and regulations
• Not bring prohibited items or substances onto the premises

Health and Safety

• Consult with healthcare professionals before beginning any fitness programme
• Inform us of any medical conditions or changes to your health status
• Exercise within your physical capabilities and follow trainer guidance
• Use protective equipment when required
• Report any injuries or incidents immediately

Payment Terms

Payment terms for nextaras services are as follows:

• Membership fees are due in advance according to your chosen payment schedule
• Personal training and additional services require separate payment
• Payments must be made by accepted methods (card, bank transfer, cash)
• Late payment may result in service suspension or additional fees
• Refunds are subject to our cancellation policy and applicable law

All prices are in Euros and include applicable VAT. We reserve the right to change our pricing with appropriate notice to existing members.

Cancellation and Refunds

Cancellation policies vary by service type:

Membership Cancellation

• Monthly memberships require 30 days written notice
• Annual memberships may be cancelled with appropriate notice as per Spanish consumer law
• Cancellation must be submitted in writing to contact@nextaras.world

Personal Training and Classes

• Sessions must be cancelled at least 24 hours in advance
• Late cancellations may result in charges
• Unused sessions may be rescheduled within the package validity period

Intellectual Property

All content, materials, and intellectual property related to nextaras, including but not limited to our logo, training programmes, website content, promotional materials, and proprietary fitness methodologies, are owned by nextaras S.L. or our licensors.

You may not:

• Copy, reproduce, or distribute our proprietary training programmes or materials
• Use our trademarks, logos, or branding without written permission
• Record or photograph training sessions without explicit consent
• Share confidential information or trade secrets
• Use our intellectual property for commercial purposes

Any feedback, suggestions, or ideas you provide to us may be used by nextaras without compensation or attribution.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to our data practices as described in our Privacy Policy.

Health and Medical Disclaimers

Important health and safety information:

• Exercise involves inherent risks, and you participate at your own risk
• You should consult with a physician before beginning any fitness programme
• Our trainers are fitness professionals, not medical doctors
• Nutrition advice is for general wellness purposes, not medical treatment
• You must inform us of any medical conditions or physical limitations
• Stop exercising immediately if you experience pain, discomfort, or unusual symptoms

nextaras does not provide medical advice, diagnosis, or treatment. Always seek professional medical advice for health concerns.

Limitation of Liability

To the maximum extent permitted by Spanish law, nextaras S.L., its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

• Use of our facilities, equipment, or services
• Injuries or health issues related to exercise or fitness activities
• Loss or theft of personal property on our premises
• Interruption or suspension of services
• Errors or omissions in our programmes or advice
• Actions or omissions of other members or third parties

Our total liability to you for any claim shall not exceed the amount you have paid to nextaras in the 12 months preceding the claim.

This limitation of liability does not exclude or limit our liability for death or personal injury caused by our negligence, fraud, or other liability that cannot be excluded under Spanish law.

Indemnification

You agree to indemnify, defend, and hold harmless nextaras S.L., its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your use of our services or facilities
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your negligent or wrongful conduct
• Any injury or damage to third parties caused by your actions

Force Majeure

nextaras shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, pandemics, strikes, or other unforeseeable events ("Force Majeure Events").

During Force Majeure Events, we may suspend services temporarily. We will make reasonable efforts to resume normal operations as soon as possible and will communicate with members regarding service disruptions.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, specifically the laws applicable in Catalonia. Any disputes arising from or related to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights under applicable consumer protection laws.

Dispute Resolution

For consumer disputes, you may also have access to alternative dispute resolution mechanisms, including online dispute resolution platforms provided by the European Commission.

Termination

We reserve the right to terminate or suspend your membership and access to our services immediately, without prior notice, for any of the following reasons:

• Violation of these Terms or facility rules
• Inappropriate or disruptive behaviour
• Non-payment of fees after appropriate notice
• Providing false or misleading information
• Conduct that may harm other members or staff
• Illegal activities on our premises

Upon termination, your right to use our services will cease immediately. Termination does not relieve you of any payment obligations incurred before termination.

You may terminate your membership in accordance with our cancellation policy outlined in these Terms.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements you may enter into with nextaras, constitute the entire agreement between you and nextaras regarding your use of our services and supersede all prior or contemporaneous communications and proposals.
